and what appear to be fragments of bbs and nails possibly contained in a pressure cooker device. >> no matter who was responsible boston residents are refusing to let this attack define their city. >> terrorism is about creating fear in changing the way you live. >> we will not do that. i refuse to do it! >> president obama has been receiving briefings especially over night on this incident. however, he will come to boston tomorrow for an interfaith prayer service scheduled for tomorrow morning. reporting live in boston. i am emily schmidt n. >> a bay area boy was at the site of the marathon is scheduled to undergo another surgery today. he was wounded in the blast. 11 year-old asron hern of cortines, was along the raise route, cheering on his

mother at the time of the explosion. his grandmother is shocked at what has happened to her grandson. >> it is heartbreaking that you have to go places and not be comfortable that we're going to be safe. we're trying to make the best of it and put our faith in our government. i hope president obama will take care of this. >> he is a bright, happy, very athletic. he plays football, baseball, basketball. he does really very well in school. >> aaron is in stable condition although he is in the intensive care unit. the family will stand boston for least another weekeries. >> teachers and students at his school are looking into how can help the family. >> the city of martinez is a close-knit community. and when word without that one of their own, the hern family became victims of the boston marathon attack. they

highway 92. the drive 12-13 minutes. >> south bound 101, a handful of cars working of the north bay into san francisco. >> no wait at the toll plaza. no incidents to report and we're seeing green on the road way censors coming out of the north bay. >> thank you erica. five teenagers are in custody this morning for the murder of a bay area paramedic killed in the oakland hills earlier this month. police said the suspects have been charged with killing each in t quinn boyer . o pd says there was only one personal pull the trigger, but all five are being charged with homicide, robbery, and carjacking. investigators say this is an isolated incident. all the teenagers involved are between 14 and 16 years old and lived in oakland. police recovered the car involved in the murder two days after it happen but they're still looking for the murder weapon.

three suspects before or after the hearing at juvenile hall yesterday morning in san jose. the boys were arrested last week at saratoga high school, in connection with the september 2012 incident the assault allegedly occurred at a house party, after she passed out from drinking, according to our attorney. a week later, audrey committed suicide when the lewd photograph of her prodigiwere digitally passed among their classmates. a county prosecutor also declined to comment about the case positively but did allied with court is considering as it decides whether to release the boys of custody. >> they have a stable home but consider whether the minor is going to school, are they truant, what type of stability they have. the court will consider all the factors in making a decision and determining whether they should remain in juvenile hall pending the case. >> on monday, the pott

family and their attorney addressed the media calling for the defendants to be tried in open court, as adults. a decision on that could take up to a month. >> a bipartisan drive to expand background checks on gun is in trouble this morning. today, the senate plan to vote on the proposal. but a growing number of republicans are voicing their opposition to the measure. so unless supporters of the bill concern owes around the measure sure to be defeated. a survey done this month shows a 49 percent of americans favor strict gun- control. that is down from the 58% in january just after the shooting in new town, conn. >> president obama is urging the senate to move quickly on a comprehensive immigration overall drafted by a bipartisan group of senators. obamas says the bill is a compromise measure that nobody will get everything he wants, including him. but he says it is largely consistent
